Homemade porn has always been there, but production and distribution costs have kept it as a junior partner to the professional producers. Smart phone cameras, web cams, cheap web space and affordable editing software are changing all that. Today anyone who wants to shoot some porn at home can do it - the ‘Do it Yourself’ age of porn has arrived.

Sexting – the most commonly discussed version of homemade porn – provides some signs for how the debate is likely to run. Critics claim that it is corrupting our children – an argument that conflates a pair of naked breasts with a smart phone video of some guy getting a blowjob from his girlfriend. It is a matter of degrees, but condemnation comes easy when you only see the world in black and white.

Government regulation is likely to be challenged by the emergence of homemade porn, with its difference being that money generally doesn’t change hands.

There is no ‘workplace’ for government policies to regulate. There are no employment agreements or contracts that can be tested in the courts. All we have is consenting adults doing legal thinsomegs and recording themselves at it.

This poses a quandary. Porn is the production, possession or distribution of people having sex. Governments can legislate to ban production and possession, but in the case of homemade porn policing those regulations will be a matter of luck. The arrest and trial of Simon Walsh in the UK is a case in point.

An openly gay and highly successful lawyer and alderman of the city of London, Walsh had his place raided by police looking for child porn. They didn’t find any. What they did find were tapes including some of Walsh and his friends having sex, including fisting. Walsh was charged under the nation’s extreme porn laws on the basis that fisting was likely to cause physical harm to ones genitals or anus. The jury disagreed and Walsh was found innocent.

As a former policy worker in government, one of the things that I learnt is that governments tend to replicate what other jurisdictions have done, and then add in a couple of extra rules of their own. The UK’s extreme porn laws could mutate into other jurisdictions, but hopefully we won’t descend to the triviality of the case against Indonesian rock star NazrilIrham.

Irham was sentenced to three and half years when video of him having sex with two different women went viral. Irham’s defense was that the video was private and a production engineer had stolen it of his computer. The bench wasn’t impressed and formed a view that he should have done more to prevent the theft of his video. He was released after serving two years.

Homemade porn is here and growing. Those who crusade against pornography will up their efforts as they begin to understand that consumers can become producers. Certainly some regulation is needed – ‘revenge’ videos where someone distributes content without the consent of others in the video is unethical. Policy makers can hang their hat on three premises: regulating the relationships involved in producing the content, regulating the content itself, or regulating distribution.

Regulating the relationships involved in producing the content is problematic because of the voluntary nature of homemade porn. Regulating production and content, along the lines of the UK’s extreme porn laws, is challenging because porn is ultimately in the eye of the beholder. Distribution can be regulated – but what if it is sharing it with friends or others for free. Regulating the homemade sector will have knock on effects for the professional industry. An opportunity exists to push for greater liberalization in the acknowledgement that porn is being democratized through the emerging homemade sector. Or there is the risk that puritanical forces will push for even more restrictive legislation.
